TOS (TERMS OF SERVICE) CONTRACT AGREEMENT

This is an online contract and using the process of IP verification, Service Provider Information and digital date and time stamps will be considered a legally signed document upon acceptance of products or services rendered by Indy Affordable Wedding Services to the consumer.
TOS Contract Definitions - Definitions used in this TOS Online Contract are as follows: Staff, Personnel, Employees and Affiliates are considered employed service providers of Indy Affordable Wedding Services - Consumer will be considered, YOU after the point of any product sale, scheduled event services or any other form of business where products or services are received by you the (consumer).
Indy Affordable Wedding Services will not give out, disclose or sell any of your personal information, financial information, IP address or any other information entered on this website to any source or outsource outside the Indy Affordable Resource Company. By viewing this website or any of it's content or associated content, you acknowledge that you agree to our TOS and there for will be bound to these terms upon consumption of any of our products or services, and by law, bound to any payment agreement that is set fourth and confirmed by you and Indy Affordable Wedding Services. Content Privacy Restrictions
All content on this website is the sole property of it respected owner and can not in any way be copied, in part or complete for any reason at all without prior written consent of the content owner and or affiliates. This includes but is not limited to, written content, form content, images, audio files, video files, personal or company addresses or contact information.
Employee & Affiliate's Personal Information Restrictions
Any personal or contact information of our employees and or affiliates will be used for operations through Indy Affordable Resource Company purposes only and can not be used for any other source or reason outside the operations of this firm. You are not allowed to contact our employees and or affiliates for any reason outside the company operations. Any and all inquires of our employees and or affiliates will be handled by our main office or our human resources department. Indy Affordable Resources will not give out any personal information about our employees and or affiliates to any 3rd party source without prior written consent of the employee or affiliate in question.
Indy Affordable Wedding Services Contractor Rules
Appearance & Hygiene - You will show up at your scheduled event in good appearance, with either a uniform selected by Indy Affordable Wedding Services, or a shirt and tie for formal events. Your hygiene is expected to be acceptable by the event guests, any complaints from these guest can and will result in disciplinary action.
Punctuality & Tardiness - You are expected to begin your show on time without exception, so be sure to leave early and allow yourself plenty of time for traffic, or any setup issues you may encounter at the scheduled event. If you have equipment issues or must cancel a job order, you must let Indy Affordable Wedding Services know at the earliest available time possible. Failure to contact Indy Affordable Wedding Services staff of this information can and will result in disciplinary actions including but not limited to suspension and termination. Tardiness will result in loss of pay for 1 complete hour for every 0-60 minutes your are tardy.
Attitude & Professional Courtesy - You are representing Indy Affordable Wedding Services and there for are required to always use a professional attitude during any time period you are at the said event, even during setup and initial arrival periods. Every source of business conducted with the guests or consumer is expected to be handled in a professional manner, including but not limited to taking requests, answering questions, coordination communications and irate guests or consumers.
Equipment & Other Indy Affordable Resource Properties - All equipment or other properties loaned or rented to the contractor will be respected and returned in good working order, before 11:00 AM on the morning following the date of the scheduled event, unless the office is closed on this day, in which case the items will be returned on the next open business day.
Late Returned Equipment Fees - Any loaned or rented item(s) that is returned after 11:00 AM on the day following the scheduled event, unless the office is closed, in which case, the next open business day, will incurr a daily late fee of no less then $5.00 and no greater then $20.00 per loaned or rented item. If the item(s) are not returned, on or before the cost of the total item(s) is aquired through late fees, the item(s) will be listed as a charge off and you will be charged for the full cost of the item(s) and a restocking fee of no less then $5.00 and no more then $100.00 for each item replaced.
Premature Event End Of Service - Any premature event cancellation or ending of service without the written or verbal consent of the consumer, will result in loss of pay for the entire event, including travel and compensation pay. Furthermore, this action can and will also result in further disciplinary actions including but not limited to, employment suspension and or termination.
Our Strict Non Smoking Policy - Contractors employed by Indy Affordable Wedding Services will not be permitted to smoke during the event and anywhere on the property of the scheduled event, unless instructed by the consumer and an appropriate designated smoking area is supplied. Contractors MAY NOT SMOKE during live performance times, even if the consumer says it is okay.
Indy Affordable Wedding Services Consumer Agreement
Initial Deposite For Scheduled Event - An Initial Non Refundable deposit of at least 1/4th of the cost of the services to be rendered is to be collected 2 weeks prior to the scheduled event for any services over $200.00 in total costs, if the service to be rendered is less then $200.00 in total, then a deposit of at least 1/2 of the total service cost will need to be collected 2 weeks prior to the scheduled event date. In rare cases where last minute bookings are concerned, or any scheduled event service to be rendered without at least a two week prior preparation period, the total cost of the service to be rendered will be collected before the event service will be considered a set booking date. The remainder of the total cost for services to be rendered will be collected the day of the event, before any equipment is unloaded or setup.
Cancelations or event rescheduling - If a consumer should decide to cancel an event or performance, this decision must be submitted in writing or in an email message at least 7 days before the event is scheduled to occur to avoid loss of deposited funds, all cancellations are subject to a 25% re-booking fee, not to exceed the full deposit amount for re-booking of the scheduled event date. Upon failure to submit a 7 day notice to Indy Affordable Wedding Services the consumer waives all rights of the initial deposit fee. In the event of an event that needs to be rescheduled to a later or earlier date and time, can be done by submitting in writing or an email message the request for the change of service date and time, no penalties will be acquired as long as the scheduled event continues on the new rescheduled event date. No deposits will be refunded for event rescheduling.
Equipment Liability and disclosure - All equipment is the sole property of Indy Affordable Weddings Services, it's affiliates or employees, and Indy Affordable Wedding Services, it's affiliates or employees reserves the right to deny use of equipment to anyone they feel may be of harm to such equipment or themselves. There will be no permitted beverages on the master equipment table or around any other areas where such equipment may be placed, there will be no guests permitted at anytime to be behind the master equipment table, all guests are to remain on the front side of the table at all times. The DJ, Karaoke Host or Live Entertainment personnel reserves the right to shut down and move equipment to a safe place should there be severe weather, a fight situation, faulty wiring or any other incident by uncontrollable circumstances or acts of GOD disaster situations that could potentially harm such equipment. Any damage to such equipment due to failure to comply with any or all of these regulations will be the sole responsibility of the consumer. If such equipment is damaged by the consumer, event guests or any other present party, invited or not, the consumer will be responsible for such damages. In the event that equipment needs to be repaired or replaced, the consumer will have a time period of 7 days to make such arrangements for repair costs or replacement equipment, if consumer has failed to comply with the 7 day allowance, then the consumer may also be charged for any rescheduled event(s) lost due to the equipment damage status and lack of compliance. Should the consumer fail to yet still to comply, then further civil actions will be taken and the consumer will then be responsible for any court cost, attorney fees and other resources required to pursue this situation further.
Legal Action Jurisdiction Regulations - The consumer understands and agrees that any arbitration or court cases by either party will be of the jurisdiction of Johnson country, as Indy Affordable Wedding Services, resides in Johnson country, in the event that the consumer pursues court appearances or arbitration\'s outside Johnson county, the consumer will be responsible for any and all travel expenses, court costs and attorney fees.
Staff or Personnel Safety - Indy Affordable Wedding Services, or any staff or personnel attending an event reserves the right to cease the service or performance if a situation should occur that puts in danger the safety of the staff or personnel, in such cases of injury, or harm whether this is caused by the consumer, guests, any other persons attending, invited or not or out of control acts of GOD or nature. In these rare but serious cases, the consumer is responsible for resolving these types of incidents within at least 30 minutes or forfeit the continued duration of the service. In the event that the situation is not resolved within 30 minutes the consumer will still be responsible for all contract fees in full and no refund will be adjusted due to such circumstances. Furthermore the consumer will also be held legally and financially liable for any injury or harm that the staff or personal may sustain as a result of such an incident.
Staff or Personnel Replacements - It is understood by the consumer that Indy Affordable Wedding Services reserves the right and obligation to replace any member of staff or personnel should the scheduled staff or personnel member become unavailable for any reason or cause. If for any reason the previously selected staff or personnel member should fail to appear or is replaced Indy Affordable Wedding Services will replace them with a staff or personnel member of choice and will do everything possible within the power of the firm to comply with the original service contract, services and time previously agreed upon by the consumer. If for any reason Indy Affordable Wedding Services is unable to fulfill the original service contract terms within reason, the consumer will receive a full refund, minus the non refundable initial deposit.
Attendance & Ealry Dismisal Compensation - Indy Affordable Wedding Services initial contract fees in total shall not be effected in the event of tardiness of staff or personel due to rain, snow, wind, severe weather, road conditions, traffic accidents or any other act of GOD or un controllable circumstances that are out of the control of the staff or personel member, further more, staff or personel members are allocated a 30 minute window due to these types of circumstances. The Initial contract fees in total will also not be affected if the consumer requests or forces the staff or personel to leave an event before the schedule end time of that event or service, in this case the consumer will still be responsible for the full amount agreed upon the scheduling of the service or event.
Definition in association with the NON REFUNDABLE DEPOSIT - Our non refundable deposit terms are as follows and can not be changed or negotiated without written consent of Indy Affordable Wedding Services Management Department. The term Non Refundable Deposit refers to the initial deposit due upon the booking of said service or event, in the event the service agreement is terminated by either party, this deposit will not be refunded in part or in whole, no matter what the cause of the termination of the service contract. The consumer here by agrees the initial deposit submitted upon the scheduled service is Non Refundable and therefor waive their right to any refund of this inital deposit, in the event that the scheduled service is canceled, Indy Affordable Wedding Services will use these moneys to pay employee staff or personel for their time and services aquired for the intial handlings and resources of the previously scheduled service.
Late Fees for non received payments or delinquant accounts - All payments of the total amount due are required before the service is scheduled to begin, if payment in full is not received, Indy Affordable Wedding Services reserves the right to cancel scheduled service(s) and the consumer will loose the full deposit made upon the scheduling of said service(s). Payment options may be approved by Indy Affordable Wedding Services Management Department, no non member of management has the authority to approve payment options, if a payment option is allowed by Indy Affordable Wedding Services, and the consumer fails to pay the payments on time or in full, then Indy Affordable Wedding Services will charge an additional late fee of up to 17% APR for the total remaining total balance of unpaid service(s), not to exceed 2 times the total balance plus any legal fees such as court fee, collection fees, or any other resources acrued while trying to resolve this deliquent payment situation. In addition any declined credit card payment, credit card charge back, or insuffient funcd in any manner will result in a $40.00 NFS Fee for each failed transaction with a maximum of 5 transaction attemps.
Staff Food, Beverage and Break Policy - The consumer is responsible for supplying the staff or personel member(s) with food and beverages should their event or service(s) require the staff or personel members to remain at the event for more then 3 hours, the consumer is responsible for supplying the staff or personel members with free beverages throughout the durration of the event no matter how long the scheduled event durration, furthermore the consumer is required to supply the staff or persnel members with suitable restroom accomidations. If in rare cases the staff or personel member will remain at the event for a term no less then 8 hours, then the consumer is responsible for supplying the staff or personel members with 2 - fifteen minutes breaks and 1 - thirty minute uninterupted dinner/lunch break as well as food and beverages for such break. In the rare cases where staff or personel members might remain at an event for an extended durration of 12 hours or more such as a fund raiser or benefit event, the consumer is repsonsible for supplying the staff or personel members with at least 4 - fifteen minute breaks and no less then 2 - thirty minute breaks for every 12 hour durration of the event.
Photo & video footage policy - Indy Affordable Wedding Services reserve the right to deny staff or personel members being photographed or video taped during an event, no photographs or video footage for any other use then personal memorafilia will be permitted or allowed without written consent of Indy Affordable Wedding Services Management Department. The consumer also agrees that Indy Affordable Wedding Services may take photos or video footage of the scheduled event for promotional use, it will be deemed that the consumer agrees to allow their event to be photographed or video taped for promotional uses unless Indy Affordable Wedding Services receives a written request at least 5 days before the scheduled event. If no request has been received then Indy Affordable Wedding Services assumes the consumer has agreed to the terms of this policy and therefor this online documentation will act as a digital release form for such photographs or video footage.
